Terms of Service

These Terms of Service ("Terms") govern your use of AutoShopCRM (the "Service"), operated by AutoShopCRM ("we", "us", "our"). By using the Service you agree to be bound by these Terms.

1. Account

You must provide accurate information when registering. You are responsible for safeguarding your password and for all activity under your account. Notify us immediately at support@autoshopcrm.com of any unauthorized access.

2. Subscription & Billing

Paid plans are billed monthly or annually in advance via Stripe. Your subscription auto-renews until you cancel. You may cancel at any time from your account settings; cancellation takes effect at the end of your current billing period. We do not offer pro-rated refunds for partial months.

3. Free Trial

New accounts include a 14-day free trial of any paid tier. No credit card is required to start the trial. At the end of the trial your account is downgraded to read-only until you choose a plan.

4. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited bulk SMS or email (spam)
  • Violate the TCPA, CAN-SPAM, or any applicable privacy law
  • Upload malicious code, attempt to disrupt the Service, or probe for vulnerabilities
  • Resell or sublicense the Service without our written consent
  • Store or transmit personal health information (PHI) or payment card numbers outside of integrated payment processors

5. Customer Texting & TCPA

You are solely responsible for obtaining valid prior consent from your customers before sending SMS messages through the Service. We provide opt-in capture and STOP/HELP keyword handling, but compliance is your obligation. We may suspend accounts that generate excessive opt-out or carrier filtering complaints.

6. Your Data

You retain all rights to data you upload (customer records, photos, RO data). We use your data only to provide the Service. You may export your data at any time as CSV. We do not sell your data. We delete your data within 30 days of account closure unless legally required to retain it.

7. Service Availability

We target 99.5% uptime. We do not provide SLA credits at this stage of the Service. Planned maintenance will be announced via email at least 24 hours in advance.

8. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranty of any kind. To the maximum extent permitted by law, our aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Indemnification

You agree to indemnify and hold us harmless from any claim arising out of your use of the Service in violation of these Terms or applicable law.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 14 days before they take effect.

11. Governing Law

These Terms are governed by the laws of the State of Indiana, USA. Disputes shall be resolved in the state or federal courts located in Delaware County, Indiana.
